Rubbish Removal Elephant and Castle Service Terms

These Terms and Conditions set out the basis on which Rubbish Removal Elephant and Castle provides rubbish removal and waste collection services. By making a booking, confirming a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

1.1 We, us, our refers to Rubbish Removal Elephant and Castle, the provider of waste collection and rubbish removal services.

1.2 You, your, customer refers to the individual or business requesting and or paying for our services.

1.3 Services means any rubbish removal, waste collection, clearance, loading, transportation, and disposal work carried out by us.

1.4 Premises means the property, building, land or area where the services are to be provided.

1.5 Waste means the items, materials, rubbish, junk, or refuse that you ask us to remove, subject always to applicable waste regulations and these Terms and Conditions.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services, including but not limited to household rubbish clearance, commercial waste removal, bulky item collection, and general waste transport to licensed disposal or recycling facilities.

2.2 The exact scope of the services, including the type and approximate volume of waste, access arrangements, and any specific requirements, will be agreed with you at the time of booking or quotation.

2.3 We reserve the right to refuse to remove any items that are prohibited by law, unsafe to handle, or which in our reasonable opinion present a health, safety or environmental risk.

3. Booking Process

3.1 Bookings can be made by telephone, email, or through any booking channels we may make available from time to time.

3.2 When you make a booking, you must provide accurate and complete information regarding:

a the address of the premises

b the nature and approximate quantity or volume of the waste

c access arrangements and any parking or loading restrictions

d any special handling requirements or potential hazards.

3.3 Any quotation provided prior to our arrival is based on the information you supply. If on arrival the actual waste or site conditions differ significantly, we may revise the quotation and seek your approval before proceeding.

3.4 A booking is only confirmed when we have accepted your request and provided you with a confirmation, which may be given verbally, in writing, by text message, or by email.

3.5 We will use reasonable efforts to attend on the agreed date and time window. However, attendance times are estimates only and may be affected by traffic, weather, delays at previous jobs, or other circumstances beyond our control.

4. Access and Parking

4.1 You are responsible for ensuring that we have suitable access to the premises and to the waste that is to be removed. This includes providing any necessary keys, codes, permissions, or authorisations required for entry.

4.2 You must ensure that there is safe and reasonable access for our vehicles and operatives, including any necessary parking or loading permissions.

4.3 Any parking charges, permits, or fines incurred as a direct result of the provision of the services at your premises may be added to your invoice, unless caused by our negligence or failure to follow your reasonable instructions.

5. Customer Obligations

5.1 You confirm that you are either the owner of the premises and the waste, or that you have the full authority of the owner to request removal of the waste.

5.2 You must ensure that all waste you ask us to collect is clearly identified and separated from any items you wish to keep. We cannot be held responsible for the removal of items which you have not clearly indicated should be retained.

5.3 You must inform us in advance of any waste that is hazardous, potentially harmful, or subject to special handling or disposal requirements.

5.4 You agree not to include within the waste any items that we have notified you we cannot remove, or which are prohibited under applicable waste legislation.

6. Waste Types and Regulations

6.1 We operate in accordance with UK waste management legislation and duty of care requirements. We will transport waste only to authorised facilities and will take reasonable steps to ensure that it is treated, recycled or disposed of lawfully.

6.2 We do not normally collect certain types of hazardous or specialist waste, including but not limited to:

a asbestos or materials containing asbestos

b clinical or medical waste

c chemicals, solvents, paints, oils, or fuels except where expressly agreed

d explosives, pressurised containers, or flammable substances

e biological or contaminated waste.

6.3 If hazardous or prohibited waste is presented for collection without prior disclosure, we may refuse to handle it, leave it on site, or, if already loaded, return it to the premises. You will be liable for any additional costs, losses or regulatory consequences arising from the misdescription of such waste.

6.4 Upon request and where appropriate, we may provide a waste transfer note or other documentation required under relevant waste regulations.

7. Pricing and Quotations

7.1 Our charges are usually based on one or a combination of volume of waste, weight, labour time, access difficulty, and any disposal or recycling fees.

7.2 Any quotation given before our arrival is an estimate only and may be adjusted once our operatives have inspected the waste and site conditions.

7.3 Where we give you a revised price on site, we will seek your agreement before proceeding. If you do not agree to the revised price, we may cancel the service, and you may be liable for a call-out charge if previously notified.

7.4 All prices are provided in pounds sterling and may be subject to VAT where applicable.

8. Payments and Invoicing

8.1 Payment is due on completion of the services, unless otherwise agreed in writing in advance.

8.2 We may accept various forms of payment, including cash, debit or credit card, and bank transfer. The available payment methods will be confirmed when you book.

8.3 For business customers with approved accounts, invoices are payable within the agreed payment period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

8.4 If you fail to make payment on time, we may charge interest on overdue sums at the statutory rate and or recover reasonable costs of debt collection.

8.5 We reserve the right to withhold or suspend services if payment terms are not met or if there is a history of late payment.

9. Cancellations and Amendments

9.1 You may cancel or reschedule a booking by contacting us as soon as possible. We encourage customers to give at least 24 hours notice where practicable.

9.2 We reserve the right to charge a cancellation fee or call-out charge where:

a you cancel or significantly change the booking with less than 24 hours notice

b our operatives attend but are unable to carry out the work due to lack of access, absence of an authorised person, or incorrect information about the waste or premises.

9.3 If we need to cancel or reschedule your booking due to circumstances beyond our control, we will inform you as soon as reasonably practicable and offer an alternative date or time. We will not be liable for any indirect loss arising from such changes.

10. Performance of the Services

10.1 Our operatives will carry out the services with reasonable care and skill, taking into account health and safety considerations and any site-specific instructions agreed with you.

10.2 We will use reasonable efforts to minimise disruption and to leave the area where waste has been removed in a tidy condition, subject to the nature of the premises and any pre-existing condition.

10.3 We may take photographs of the waste before and after removal for our records, for compliance purposes, and to assist with any subsequent query or dispute.

11. Liability and Limitations

11.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded under applicable law.

11.2 Subject to clause 11.1, our total liability to you in respect of any claim arising out of or in connection with the services shall be limited to the amount paid or payable by you for the services giving rise to the claim.

11.3 We shall not be liable for:

a loss of profits, business, revenue, or anticipated savings

b loss of or damage to goodwill or reputation

c indirect or consequential loss or damage.

11.4 We are not responsible for pre-existing damage to your premises or property, or for any damage caused by inherent defects, structural weakness, poor construction, or hidden hazards.

11.5 You must notify us in writing of any alleged damage or issue arising from the services as soon as reasonably possible and in any event within 7 days of the service date. We may inspect the premises and request supporting evidence before considering any remedy.

12. Items of Value and Miscollected Goods

12.1 You are responsible for ensuring that no items of value, personal documents, or goods you wish to keep are mixed with the waste to be removed.

12.2 Once waste has been loaded onto our vehicle and removed from the premises, it will generally not be possible to retrieve individual items. We accept no liability for loss of items inadvertently presented as waste.

12.3 If we discover an item of apparent value or personal significance before leaving the premises, we will take reasonable steps to bring it to your attention.

13. Health and Safety

13.1 We operate in accordance with applicable health and safety legislation and our internal policies. Our operatives may refuse to carry out any activity which in their reasonable opinion poses an unacceptable risk.

13.2 You agree to take all reasonable steps to ensure a safe working environment, including keeping children and pets away from the work area and advising us of any known hazards.

14. Data Protection and Privacy

14.1 We may collect and process personal data such as your name, contact details, and service history for the purposes of handling bookings, providing services, issuing invoices, and managing customer relationships.

14.2 Your information will be handled in accordance with applicable data protection law. We will not sell your personal data and will only share it where necessary to provide the services, comply with legal obligations, or enforce our rights.

15. Force Majeure

15.1 We shall not be in breach of these Terms and Conditions, nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control.

15.2 In such circumstances, we may suspend the services for the duration of the event or, where necessary, cancel the affected booking and refund any payments for services not performed.

16. Variations to Terms

16.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to the services provided.

16.2 Any change that materially affects ongoing or future services to you will be brought to your attention where reasonably practicable.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the services shall be governed by and construed in accordance with the laws of England and Wales.

17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services.

18. Severability

18.1 If any provision or part-provision of these Terms and Conditions is or becomes invalid, unlawful or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable.

18.2 If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of the Terms and Conditions.

19. Entire Agreement

19.1 These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between you and us in relation to the services and supersede all prior discussions, correspondence, or understandings.

19.2 You acknowledge that you have not relied on any statement, promise, or representation not expressly set out in these Terms and Conditions.
